Applicable regulations:
The privacy policy has been designed in accordance with the prescriptions of the European Personal Data Protection Regulation RGPD 679/2016 of 27 April and the Organic Law on Personal Data Protection and Guarantee of Digital Rights LOPDGDD 3/2018 of 5 December.
Purpose of the processing of personal data.
1. Registration of end users: Storage of favourite properties and favourite search filters to facilitate browsing.
2. Newsletter registration: Commercial communication about featured properties that may be of interest to the registered user.
3. Fulfilment of legal obligations: We will hand over the data stored by any user by legal requirement of a court or legal authorities with the power to do so.
Legal basis for processing:
The legitimacy of the processing of personal data is granted by compliance with Article 6 of the GDPR in which in its first paragraph it states the following:
1. Processing shall only be lawful if at least one of the following conditions is met:
a) the data subject gave his or her consent to the processing of his or her personal data for one or more specified purposes;
b) the processing is necessary for the performance of a contract to which the data subject is party or for the implementation at his or her request of pre-contractual measures;
c) processing is necessary for compliance with a legal obligation applicable to the controller;
Data collected and type of legitimation.
The data collected will be in some cases for legitimate interest and in others, by express consent of the interested party:
A. Private users with a profile: Users who show interest in the properties published in the Visaverde portal, registering their details in the aforementioned portal. The personal data collected are the minimum necessary, as well as their favourite properties and searches.
B. Private users who are subscribers to the informative bulletin (newsletter): Users subscribed to the newsletters sent periodically by Visaverde.
Automated processes will be carried out such as the publication of featured properties, either within the portal or by sending the corresponding newsletter.
All users can exercise their rights of access, rectification, opposition, portability and oblivion.
Recipients and transfer of data.
The recipient of the data is Visaverde as part of its professional and/or commercial activity. However, Visaverde may use external companies as required to send the aforementioned newsletters, in which case the data will be transferred to third parties for these purposes only.
Time and criteria for the conservation of the data.
In general, the data will be kept for an indefinite period of time and in any case for the duration of the contractual relationship in which it exists. The interested party may, in any case, exercise his or her right to oppose the retention of the data.
Security measures applied
The data will be stored in an encrypted server with a user name and password that will only be accessed by the owners of Visaverde, its employees or companies contracted for the management of the database. Both employees and external companies have signed the corresponding contract of confidentiality and / or processing assignment.
Exercise of Rights
It is obligatory to inform the interested parties that they have the right to request access to their personal data, its rectification or suppression, limitation of its processing or to oppose its processing, as well as the portability of said data.
The right to lodge a complaint with the supervisory authority (Spanish Data Protection Agency https://www.aepd.es).
The right to withdraw consent at any time (this must be stated on the same form on which consent is requested).
